§ 1General provisions
1.1These Terms set out the rules for using Plazer, a messenger provided by Michał Fox, ul. Józefa Mackiewicza 25, 31-214 Kraków, Poland, email: kontakt@plazer.org (the "Operator").
1.2These Terms are terms for the provision of electronic services within the meaning of article 8 of the Polish Act of 18 July 2002 on the provision of electronic services. The Operator makes them available free of charge at plazer.org in a form you can download, store and print.
1.3By creating an Account or using the Services, the User accepts these Terms. Anyone who does not accept them may not create an Account or use the Services.
1.4The processing of personal data is described in the Privacy policy, and reporting vulnerabilities on the Security page at plazer.org.

- the Plazer app available at app.plazer.org, opened in a browser tab or installed from the browser on a phone, tablet or computer.

§ 3The Services and technical requirements
3.1Within the Services the Operator provides free of charge in particular: an Account, end-to-end encrypted direct messages and groups, servers with channels, voice and video calls, a profile and the other features described at plazer.org.
3.2Using the Services requires a device with internet access and an up-to-date browser with JavaScript and WebAssembly enabled. Installing the App requires a browser that can install apps from websites, and notifications on iPhone and iPad require iOS or iPadOS 16.4 or later.
3.3The contract for electronic services is concluded when the Account is created, and for using the plazer.org website when you start using it. It is concluded for an indefinite period. The User may terminate it at any time by deleting the Account under § 10.
3.4Using electronic services carries the usual risks of the internet, such as phishing for sign-in details, malware and impersonation. The User should keep their software up to date, check that the address bar shows app.plazer.org and never give anyone their password or Recovery key. The Operator never asks for them.
3.5A minor uses the Services with the consent of their legal guardian where the law requires it.
§ 4The Account
4.1A username and a password are all it takes to create an Account. The Operator does not ask for a phone number or an email address.
4.2At sign-up the App creates a Recovery key on the User's device and shows it once. The key never reaches the Operator and the Operator holds no copy of it. Nobody, the Operator included, can recreate a lost Recovery key.
4.3The Operator does not know the User's password and cannot remind the User of it. An Account with no signed-in device is restored with the password and the Recovery key. If the User loses the password or the Recovery key and has no signed-in device left, the Operator has no way to confirm the Account is theirs and will not restore access to it or to the content of encrypted conversations.
4.4The User is responsible for keeping the password and Recovery key confidential, for access to their devices and for actions taken from their Account. The Operator recommends turning on two-step verification or a passkey.
4.5The username and profile may not infringe the rights of others, mislead about identity, including impersonating other people or the Operator, or contain Content prohibited under § 5.
4.6Creating Accounts automatically or in bulk is prohibited, as is selling Accounts or sharing them with other people.
§ 5Rules of use and prohibited content
5.1The User uses the Services in line with the law, these Terms and good practice, respecting the rights and dignity of others.
5.2It is prohibited to publish or send Content that in particular:
- depicts the sexual abuse of children or sexualises minors;
- incites or glorifies violence or terrorism, or incites hatred based on nationality, ethnicity, race, religion, sex, disability or sexual orientation;
- amounts to threats, harassment or stalking, or discloses someone's personal data without consent;
- shows an intimate image of a person without their consent;
- infringes copyright, trade mark rights, personal rights or trade secrets;
- contains malware or serves phishing or fraud;
- is unsolicited commercial communication or spam;
- offers goods or services whose trade is prohibited by law.
5.3It is also prohibited to bypass the security of the Services, attempt unauthorised access to other people's Accounts, servers or data, disrupt the Services, including with denial-of-service attacks, and use the Services automatically while bypassing the interfaces provided for bots and integrations.
5.4Security testing is allowed only on your own Accounts and servers, under the rules on the Security page. Acting in line with those rules does not breach these Terms.
5.5A User who runs a bot, a webhook or another integration is responsible for what it does as for their own actions.
5.6The User keeps the rights to their Content. To the extent needed to provide the Services, the User grants the Operator a non-exclusive, free licence to store, transmit and display the Content to the people the User shared it with, for as long as it is stored in the Services. The Operator stores and transmits the content of end-to-end encrypted conversations only in encrypted form, with no access to what it says.
§ 6Moderation and reports
6.1Any message and any Account can be reported in the App. A report from a server channel goes to that server's moderators, meaning its owner and the people with moderation permissions. A report about a direct message, a group or a person outside servers goes to the Operator's moderation team.
6.2A report about a message from an encrypted conversation contains the copy of it provided by the reporter. Without such a report the Operator has no access to the content of encrypted conversations and does not review it.
6.3Illegal Content can also be reported by email to kontakt@plazer.org. The notice should say where the Content is, why the reporter considers it illegal and how to contact them, unless it concerns Content depicting the sexual abuse of children, which may be reported anonymously.
6.4The Operator handles reports without undue delay, diligently and objectively. Where the law or these Terms are breached, the Operator may hide or remove Content in the Services it runs, restrict the features of an Account, or block an Account temporarily or permanently. A blocked Account is also refused when signing in to Third-party servers.
6.5The Operator informs the User concerned about the scope of a decision and the reasons for it in an available way, unless the law or security considerations prevent it. The User may appeal a decision by writing to kontakt@plazer.org within 6 months of receiving it. Appeals are handled within 14 days.
6.6The Operator does not generally monitor Content and is under no obligation to do so. Where it becomes aware of Content indicating a criminal offence that threatens the life or safety of people, it notifies the competent authorities.
6.7The single point of contact for Users and authorities under Regulation (EU) 2022/2065 on a Single Market for Digital Services is kontakt@plazer.org. We correspond in Polish and English.
6.8Moderators of community servers, Third-party servers included, moderate them under the rules set on those servers. The Operator is responsible for moderation only on the servers it runs itself.
§ 7Third-party community servers
7.1Anyone can run a Community server on their own machine. A Third-party server is run by its operator, not by the Operator of Plazer.
7.2The operator of a Third-party server is responsible for its operation, availability, rules and moderation and for the data it stores, including the processing of personal data as its controller.
7.3The Operator of Plazer has no access to data stored on Third-party servers and is not responsible for their operation or for the Content published on them.
7.4The Community server code will be published under the AGPL-3.0 licence. Use of the code itself will be governed by that licence, not by these Terms.
§ 8+lazer
8.1Using Plazer is free. +lazer is optional support that gives cosmetic extras, such as an animated avatar, profile effects and a name gradient, and additional boosts. Call quality, file size and emoji from other servers are the same for everyone.
8.2Where +lazer is paid, the Operator states the gross price, the billing period, the payment method and the renewal rules before the purchase. The contract is concluded when the purchase is confirmed, and the Operator confirms its terms on a durable medium.
8.3Extras from +lazer belong to the Account and cannot be transferred to other Accounts or exchanged for money.
§ 9Availability and development of the Services
9.1The Operator does its best to keep the Services running without interruption but does not guarantee uninterrupted availability. There may be breaks needed for maintenance, updates and security, which the Operator announces in advance where possible.
9.2Plazer is under active development. The Operator may add, change and withdraw features, and new versions of the App load when it is opened.
9.3The Operator will announce any intention to shut down the Central server at least 30 days in advance, at plazer.org and in the App, so that everyone can download the data of their Account.
9.4The history of encrypted conversations is stored on the Users' devices. Losing every device without a history backup turned on means losing that history, which the Operator has no way to recreate.
§ 10Deleting the Account and ending the contract
10.1The User may delete the Account at any time in the App settings by entering the password and, with two-step verification turned on, the second factor. Before deletion, servers the User owns have to be handed to another member or deleted.
10.2The Account is deleted 7 days after the request, and every session is signed out at once. Signing in with the password before then cancels the deletion.
10.3After deletion the Account's profile is replaced with a deleted account label, and the Operator removes the password, keys, settings, friends, invites, blocks, notes, saved and scheduled messages and memberships of Central server servers. Third-party servers are told the Account no longer exists. Messages written on Central server servers stay in place under the deleted account label, and encrypted messages stay on their recipients' devices.
10.4Before deleting the Account the User can download its data in the App settings, together with encrypted conversations decrypted on their own device.
10.5The User can also disable the Account for a while. A disabled Account comes back on the next sign-in.
10.6The Operator may terminate the contract and permanently block the Account if the User seriously or persistently breaches these Terms or the law. For a breach that is not serious, the Operator first asks the User to stop.
§ 11Liability
11.1The Operator is liable for non-performance or improper performance of the Services under the general rules, subject to this section.
11.2The Operator is not liable for Users' Content if it is not aware of its illegal nature and, on receiving an official notice or credible information about it, promptly disables access to it.
11.3The Operator is not liable in particular for: the operation of Third-party servers and the Content on them, the consequences of the User losing their password, Recovery key or devices, interruptions caused by force majeure or by failures of networks and providers outside its control, and the actions of bots and integrations run by Users.
11.4Towards Users who are neither Consumers nor sole traders with consumer rights, the Operator is liable for the free Services only for damage caused intentionally or through gross negligence.
11.5The limitations of liability in this section do not apply to damage caused intentionally, to personal injury or to cases where the law does not allow liability to be limited. Towards Consumers and sole traders with consumer rights the Operator is liable under the general rules.
11.6The User is responsible for the Content they publish and send and for its lawfulness.
§ 12Consumers and sole traders with consumer rights
12.1These Terms do not exclude or limit the rights a Consumer has under mandatory provisions of law, in particular the Polish Consumer Rights Act of 30 May 2014 and the Civil Code. A provision contrary to them does not bind the Consumer, and the law applies in its place.
12.2A sole trader with consumer rights has protection against unfair contract terms, the right to withdraw from a distance contract and the rights for a digital service not in conformity with the contract, to the extent the law grants them.
12.3The Operator is liable to the Consumer for the conformity of digital services with the contract under chapter 5b of the Consumer Rights Act. Where a service does not conform, the Consumer may demand that it is brought into conformity and, in the cases set out in the Act, declare a price reduction or withdraw from the contract.
12.4A Consumer who bought +lazer may withdraw from the contract without giving a reason within 14 days of concluding it by sending a statement to kontakt@plazer.org. The right does not apply or expires in the cases listed in article 38 of the Consumer Rights Act, in particular where the Operator began supplying digital content with the express consent of the Consumer, who was informed of losing the right of withdrawal and received a confirmation. If the Consumer asked for the service to start before the withdrawal period ended, they pay for what was provided until the withdrawal.
12.5The Operator refunds the payment without undue delay and no later than 14 days after receiving the withdrawal statement, using the same payment method the Consumer used, unless the Consumer agrees to another method at no cost to them.
12.6A Consumer may use out-of-court complaint and redress procedures, in particular mediation or a permanent consumer arbitration court run by entities authorised under the Polish Act of 23 September 2016 on out-of-court resolution of consumer disputes, and the free help of a municipal or district consumer ombudsman. The register of authorised entities is kept by the President of the Office of Competition and Consumer Protection (UOKiK). The Operator's participation in out-of-court proceedings is voluntary.
§ 13Complaints
13.1Complaints about the Services can be sent by email to kontakt@plazer.org.
13.2A complaint should include the username if it concerns an Account, a description of the problem and, where possible, how the User would like it resolved. Missing information does not mean the complaint is left unhandled.
13.3The Operator replies to a complaint within 14 days of receiving it, to the address it was sent from or another address given in the complaint. If the Operator does not reply to a Consumer's complaint within that time, the complaint is deemed accepted.
§ 14Changes to these Terms
14.1The Operator may change these Terms for important reasons, in particular changes in the law, decisions of competent authorities, changes in the scope, manner or technical conditions of the Services, or security and the prevention of abuse.
14.2The Operator announces a change at least 14 days before it takes effect by publishing the new version at plazer.org with a description of the changes and announcing it in the App.
14.3A User who does not accept the changes may terminate the contract before they take effect by deleting the Account. A shorter period is allowed where a change is required by law or by a decision of an authority, to the extent they allow it.
14.4A change to these Terms does not affect rights the User acquired before it takes effect, in particular rights to a paid period of +lazer.
§ 15Final provisions
15.1The contract with the Operator is governed by Polish law. This choice of law does not deprive a Consumer of the protection given by mandatory provisions of the country of their habitual residence.
15.2Disputes with Users who are neither Consumers nor sole traders with consumer rights are resolved by the court competent for the Operator's place of business. Disputes with Consumers are resolved by the court competent under the general rules.
15.3Questions about the Services can be sent to kontakt@plazer.org.
15.4These Terms are in force from 24 October 2026. The Polish version is binding; the English version is a translation.
